Welcome to Retro’s! The terms “we”, “us” and “our” refer to Retro’s. Retro’s operates this store and website, including all related information, content, features, tools, products and services (the “Services”). Retro’s is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”) together with our Privacy Policy and Refund Policy describe your rights and responsibilities when you use the Services.

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you should not use or access our Services.

1. ACCESS AND ACCOUNT

You represent that you are at least the age of majority in New Zealand (18 years) or that you have given us consent to allow your minor dependents to use the Services.
You agree to provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account details and all activity under your account.

2. OUR PRODUCTS

We strive for accuracy in describing our products. However, product images (including colour and packaging) may vary depending on your device or settings.
All descriptions, specifications, and availability are subject to change without notice. We may discontinue or limit products at any time.

3. ORDERS

Your order is an offer to purchase. Retro’s may accept or decline orders at its discretion. Orders are accepted only once payment is received and confirmed.
Please check details carefully before submitting your order, as cancellation requests may not be possible once processed.
Purchases are subject to our Refund Policy and your rights under the Consumer Guarantees Act 1993.

4. Mobile Terms of Service

The Retro's mobile message service (the "Service") is operated by Retro's (“Retro's”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Retro's’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Retro's through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Retro's. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to Retros or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Retro's mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

5. PRICES AND BILLING

Prices are listed in New Zealand dollars (NZD) and include GST unless otherwise stated. Shipping costs, if applicable, are shown at checkout.
You agree to provide current, valid payment details. By providing payment details, you confirm you are authorised to use the payment method and agree to pay the amounts due.

6. SHIPPING AND DELIVERY

We aim to deliver within the indicated timeframe, but delivery times are estimates only and not guaranteed. Delays may occur due to courier issues, customs, or circumstances outside our control.
Risk of loss and ownership transfer to you when products are delivered to the address you provide.

7. RETURNS, REFUNDS & CONSUMER RIGHTS

Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. If a product is faulty, unsafe, or not of acceptable quality, you are entitled to a repair, replacement, or refund under New Zealand law.
Our Refund Policy explains additional options we may offer, such as change-of-mind returns.

8. INTELLECTUAL PROPERTY

All content, branding, images, and materials on the Services are owned by Retro’s or its licensors. You may use the Services only for personal, non-commercial purposes.
You may not reproduce, distribute, or otherwise use our content without written consent.

9. THIRD-PARTY SERVICES & LINKS

Our Services may provide access to third-party tools or websites. We are not responsible for their content, terms, or practices. Use of such tools or links is at your own risk.

10. RELATIONSHIP WITH SHOPIFY

Retro’s is powered by Shopify, but all purchases are between you and Retro’s directly. Shopify is not responsible for our products or transactions.

11. PRIVACY

We handle your personal information in accordance with the Privacy Act 2020 (NZ) and our Privacy Policy [LINK]. Shopify may also collect and process your information in accordance with its Privacy Policy, including transfers overseas.

12. FEEDBACK

By submitting reviews, comments, or feedback, you grant Retro’s a licence to use such material for business purposes. You represent that you own the rights to any material you submit and that it does not infringe third-party rights.

13. PROHIBITED USES

You may use the Services only for lawful purposes. You agree not to misuse the Services, attempt unauthorised access, or engage in fraudulent, harmful, or unlawful activities.

14. TERMINATION

We may suspend or terminate access if you breach these Terms. Certain provisions (including intellectual property, limitations of liability, indemnities, and governing law) survive termination.

15. WARRANTIES & DISCLAIMERS

Except as required by New Zealand law, the Services and products are provided “as is” and “as available.”
We make no representation that the Services will be uninterrupted or error-free.

16. LIMITATION OF LIABILITY

To the maximum extent permitted by New Zealand law:
Retro’s, its officers, employees, affiliates, or partners shall not be liable for indirect, incidental, or consequential damages arising from your use of the Services or our products.
Nothing in these Terms excludes or limits liability for breach of your rights under the Consumer Guarantees Act 1993 or Fair Trading Act 1986.

17. INDEMNITY

You agree to indemnify Retro’s against claims or losses arising from your breach of these Terms or unlawful use of the Services.

18. GOVERNING LAW

These Terms are governed by the laws of New Zealand. You agree to submit to the exclusive jurisdiction of the New Zealand courts.

19. CHANGES

We may update these Terms occasionally. Changes will be effective once posted on this page. If changes materially affect your rights, we will notify you as required by law.
